Abstract

Studija Aleksandra - Saše Zekovića, o nekim važnim aspektima primjene manjinskih i ljudskih prava u Crnoj Gori u posljednjih nekoliko godina, predstavlja značajan publicističko-teoretski doprinos sagledavanju i razumijevanju ove izuzetno osjetljive i delikatne pravno-politikološke, socijalne i kulturološke problematike. I to kako zbog tematike koju Zeković analizira, tako i zbog načina na koji to čini. Predmet analize su socio-političke prilike u Crnoj Gori posljednjih godina, posmatrane u kontekstu raspada bivše SFRJ, kao i teži slučajevi kršenja ljudskih, a naročito manjinskih prava značajnog dijela građana Republike Crne Gore. S tog aspekta Zeković razmatra ulogu crnogorske vlasti, posebno policije, u ovim procesima, nužnost suočavanja s prošlošću, denacifikaciju i lustraciju, saradnju sa Haškim tribunalom, ulogu medija, riječju - pitanja društvene i pojedinačne odgovornosti za zloupotrebe vlasti i česta kršenja ljudskih prava. Posebna pažnja posvećena je problemima manjina i konkretnim slučajevima kršenja manjinskih prava, diskriminaciji i nejednakom tretmanu pripadnika većine manjinskih naroda u ovom periodu u Crnoj Gori. Zekovićeva studija predstavlja važno istorijsko i političko svjedočanstvo o događajima koji se ne smiju zaboraviti - da se nikada više ne bi ponovili. Analizirajući konkretne slučajeve kršenja ljudskih i manjinskih prava u Crnoj Gori, Zeković promišlja njihove uzroke i posljedice i dolazi do veoma korisnih zaključaka i sugestija u vezi sa praktičnim regulisanjem i zaštitom pojedinih, važnih pitanja u oblasti ostvarivanja ljudskih i manjinskih prava. To se posebno odnosi na problem upotrebe jezika, zastupljenosti manjina u sadržajima reformisanih nastavnih planova i programa, obrazovanja na manjinskim jezicima, ispoljavanja slobode vjeroispovijesti i sprečavanja njene političke zloupotrebe. Kao značajan prilog inače prilično skromnoj literaturi posvećenoj problematici ljudskih prava u Crnoj Gori, ova studija će, i zbog svog praktičnog i zbog svog teorijskog nivoa, svakako postati obavezno štivo za sve poslenike ovog humanističkog i emancipatorskog koncepta.

Abstract

October 2000 political changeover did not produce the fundamental break with Milosevic's policy. There are numerous examples thereof, notably as regards Republika Srpska, Kosovo and Montenegro. Insistence on that orientation in the face of factual defeat had a negative impact on status of inter-ethnic relations in Serbia proper. National policy aiming at creating an ethnically pure Serb state ended with a catastrophic balance: hundreds of thousands of dead, several million displaced persons and refugees. In the past decade minorities, notably Croats (during the war in Croatia), Bosniaks (during the war in B&H) and Albanians (during the whole decade) bore the brunt of "ethnic-cleansing" policy. By extension, relations between the majority people and some minorities were exacerbated. In the meantime minorities have radicalised their stands and are waiting for resolution of their problems by dint of international community brokerage. Most conspicuous example of the aforementioned was South Serbia, in which the danger of conflict spill-over was great for a while. But thanks to NATO and other international organisations actions and efforts tension has eased and cooperation and revival of economy have been initiated owing to enormous political and financial support of the West. Serbia has entered the period of facing up to difficult and long-term consequences of nationalistic and war policy of the former regime. The entire society has been devastated, and institutions of system destroyed. Long wars, international isolation and bombardment campaign have impacted the general social mood, which is marked by high intolerance, xenophobia, anti-Semitism and emergence of neo-Nazi groups. This is all due to the political vacuum and absence of vision of Serbia's future. Such a general atmosphere affects national minorities, who feel increasingly threatened. The last census, according to unofficial information, indicates that Serbia remains a markedly multi-ethnic country. This may be explained by massive emigration or brain-drain of young and educated Serbs. About 400,000 refugees from Croatia, Bosnia and Kosovo, contrary to some expectations, have not to a larger extent changed the demographic structure of the country. Despite emigration of minorities, their percentage remained the same, in view of de-assimilation of Vlahs and Romany (they stopped identifying with Serbs). This means that the minority issue would remain the hot issue, notably if the nationalistic block continues to persist on realisation of ethnically pure state. Some ethnic communities have been territorially homogenised, hence some of them, in some areas constitute the majority population. Some national minorities, notably Albanians, Bulgarians, Croats, Hungarians, Bosniaks/Muslims, and Romanians inhabit border areas. Thus their territorial homogenisation is a complex political fact. Despite current authorities efforts to fine-tune national minorities-related domestic legislation to the European standards, situation in that regard is slowly changing because of badly impaired inter-ethnic relations in the last decade. Ethnic distance had been increased, but as of late it started dwindling, but not everywhere and not with respect to all minorities.

Abstract

The Great Union and the completion of the process of establishing the Romanian unitary national state represented a decisive moment in the modernization, occidentalization and development of Romanian law in the spirit of its traditions. In the 100 years since then, he has undergone great transformations in line with historical developments, presenting himself today as a complex legal system facing the challenges of European integration and the assertion of globalization.Thus, a multidimensional radiography of the state of Romanian law is required, by identifying the founding principles, the traits and the defining evolutions, the establishment of connections and interdependencies with European Union law, the influences of comparative law and the metamorphoses due to the impact of globalization.

Abstract

Konzultacije su organizirali Centar za građanske inicijative Poreč (Hrvatska) i Documenta Zagreb (Hrvatska). Skupu je prisustvovalo 25 sudi onika/ ca iz organizacija za ljudska prava, udruga stradalih i nestalih, organizacija mladih, ženskih grupa, profesi onalnih udruga i lokalnih vlasti u Istri. Amir Kulaglić iz Srebrenice (BiH), Vesna Teršelič (Documenta, Hrvatska) i Eugen Jakovčić (Documenta, Hrvatska) bili su predavači, dok su skup moderirali Bisera Momčinović (Centar za građanske inicijative Pula, Hrvatska) i Goran Božičević (MIRamiDA centar Grožnjan, Hrvatska). Radio Pula, Tv Nova izvještavali su sa događaja. Novi list i Glas Istre su objavili razgovor s Amirom Kulaglićem autora Mladena Radića kao i tekst "Prekinuti šutnju i poricanje" autorice Tatjane Gromače.

Abstract

Free education for all, as a right, has for the first time been presented in the Universal Declaration of Human Rights: "Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory". The importance of this right for development of society was also recognized through other relevant international documents. In this context, the International Covenant on Economic, Social and Cultural Rights, "The States Parties to the present Covenant recognize the right of everyone to education. The States Parties to the present Covenant recognize that, with a view to achieving the full realization of this right: (a) Primary education shall be compulsory and available free to all". Hence, it is a recommendation that should be respected and implemented by all signatories of this document, among who is also Montenegro. In addition, the UNESCO Convention against Discrimination in Education stipulates: "make primary education free and compulsory; make secondary education in its different forms generally available and accessible to all; make higher education equally accessible to all on the basis of individual capacity; assure compliance by all with the obligation to attend school prescribed by law".

Abstract

Priručnik za profesionalce u oblasti obrazovanja Za zajednice otporne na radikalizaciju i nasilni ekstremizam! nastao je iz potrebe da se osnaže kapaciteti obrazovnog sistema u pravcu učinkovitije prevencije radikalizacije i nasilnog ekstremizma. Radikalizacija i nasilni ekstremizam ozbiljni su izazovi sa kojima se suočavaju savremena društva, pa i Crna Gora. Obrazovanje ima ključnu ulogu u prevenciji ovih pojava i to kroz podizanje nivoa znanja i informisanosti mladih, ali i kroz razvoj vrijednosti, stavova i vještina koje će ih učiniti otpornim na privlačnost radikalnih I ektremističkih grupa i propagande.

Abstract

Ova zbirka prevevoda presuda Evropskog suda za ljudska prava o primjeni zabrane mučenja i nečovječnog ili ponižavajućeg postupanja ili kažnjavanja, objavljena je u okviru projekta "Monitoring poštovanja ljudskih prava u ustanovama zatvorenog tipa u Crnoj Gori". Ovaj projekat su od marta 2011. do aprila 2013. godine sprovele nevladine organizacije iz Crne Gore - Akcija za ljudska prava, kao nosilac projekta, Centar za antidiskriminaciju "EKVISTA", Centar za građansko obrazovanje i Sigurna ženska kuća, uz pomoć Beogradskog centra za ljudska prava i Letonskog centra za ljudska prava. Žarko Marković je odabrao presude i napisao uvod koji sadrži kratak pregled međunarodnih standarda u vezi sa zabranom mučenja i drugih oblika zlostavljanja, a zajedno sa Dinom Dobrković i preveo presude objavljene u ovoj zbirci, izuzev presude u predmetu Milanović protiv Srbije, čiji je prevod objavio Zastupnik Republike Srbije pred Evropskim sudom za ljudska prava. Nadamo se da će ova knjiga koristiti prvenstveno onima koji su odgovorni za primjenu zabrane mučenja i drugih oblika zlostavljanja u Crnoj Gori u okviru pravosuđa, policije i državnih ustanova zatvorenog tipa, u kojima borave ljudi za čiju su zaštitu neposredno nadležni državni službenici. Zahvaljujemo na povjerenju donatorima koji su finansijski podržali projekat i ovo izdanje: Evropskoj uniji, posredstvom Delegacije Evropske unije u Crnoj Gori, i ambasadi Savezne Republike Njemačke u Podgorici.
